Welcome to Mwwared (“Mwwared”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of https://www.mwwared.com and related sites or staging environments where we sell our products (the “Site”), and your purchase of our Shopify themes (the “Products”).
By browsing the Site, creating an account, or purchasing a Product, you agree to these Terms and our Privacy Policy and Refund Policy. If you do not agree, do not use the Site or purchase Products.
Mwwared operates from the United States. These Terms are governed by the laws of the United States, without regard to conflict-of-law rules.
1. Who we are
Mwwared provides Arabic-ready and multilingual Shopify themes and related digital resources for merchants. For general inquiries: info@mwwared.com. For purchase and product support: support@mwwared.com.
2. Products covered by these Terms
These Terms apply to Shopify themes sold by Mwwared as one-time digital purchases (for example Brooklyn and Casablanca). They do not currently cover Shopify apps, subscriptions, or custom services unless those offerings expressly link to these Terms.
3. Account
You may need an account to access downloads or order history. You are responsible for keeping your login credentials secure and for activity under your account. Provide accurate contact information so we can deliver Product access and support.
4. License grant (one store)
When you purchase a theme, Mwwared grants you a limited, non-exclusive, non-transferable license to install and use that theme on one (1) Shopify store that you own or operate, unless a written agreement with Mwwared states otherwise.
You may customize the theme for that store. You may not:
- Install or use the theme on more than one Shopify store without purchasing additional licenses
- Resell, redistribute, sublicense, share, lease, or give away the theme files, source, or license keys
- Offer the theme (or a derivative) as a competing product or template marketplace listing
- Remove copyright, attribution, or proprietary notices except where customization of storefront-facing content reasonably requires it
Resale or redistribution is allowed only under an explicit Mwwared partnership / distributor program with separate written terms. Contact info@mwwared.com if you want to discuss a partnership.
5. Digital delivery
Themes are digital goods. After a successful payment, we provide download or account access according to the checkout and account flows on the Site. You are responsible for downloading and retaining your files. We may re-issue access for legitimate purchasers who contact support, subject to verification.
6. Payments and Merchant of Record (Paddle)
Payments for Products are processed by Paddle. Paddle is the Merchant of Record for these transactions. That means Paddle handles checkout, payment processing, applicable sales tax / VAT / GST collection and remittance where required, and customer invoicing for the purchase.
By buying a Product, you also agree to Paddle’s applicable buyer terms and privacy practices. Pricing shown at checkout may include or exclude taxes depending on your location and Paddle’s tax calculation.
All theme purchases described here are one-time payments. There are no recurring subscriptions for these Products under these Terms.
7. Refunds
Refunds and cancellations for Product purchases are governed by our Refund Policy, which aligns with Paddle’s 14-day consumer right to cancel as described in Paddle’s Buyer Terms. Please read that policy before purchasing.
8. Support
Support for purchased themes is available via support@mwwared.com and the contact options on the Site. Support covers reasonable help with installation and documented theme features. It does not include unlimited custom development, third-party app conflicts outside our control, or Shopify platform issues.
9. Intellectual property
Mwwared and its licensors retain all rights, title, and interest in the Products, Site content, branding, and related materials. Your purchase grants a license to use the theme as described above — it does not transfer ownership of the theme’s intellectual property.
10. Acceptable use
You agree not to misuse the Site or Products, including attempting unauthorized access, interfering with Site operations, using the Site for unlawful activity, or violating Shopify’s or third parties’ terms in connection with your store.
11. Disclaimer of warranties
The Site and Products are provided “as is” and “as available” to the fullest extent permitted by law. We do not warrant that themes will be error-free, uninterrupted, or compatible with every Shopify plan, app, browser, or future Shopify platform change. Shopify may change its platform; you are responsible for maintaining a compatible store environment.
12. Limitation of liability
To the fullest extent permitted by law, Mwwared is not liable for indirect, incidental, special, consequential, or lost-profit damages arising from your use of the Site or Products. Our total liability for any claim relating to a Product purchase is limited to the amount you paid for that Product.
13. Changes
We may update these Terms from time to time. The “Updated” date above will change when we do. Continued use of the Site or purchase of Products after changes means you accept the revised Terms.
